Takov\u00e9 zpracov\u00e1n\u00ed nespad\u00e1 pod v\u00fdjimku pro novin\u00e1\u0159skou \u010dinnost podle \u010dl\u00e1nku 85 GDPR, ale podl\u00e9h\u00e1 p\u0159\u00edsn\u00fdm po\u017eadavk\u016fm na zcela nez\u00e1visl\u00fd dohled podle \u010dl\u00e1nk\u016f 51\u201352 GDPR a \u010dl. 8 odst. 3 Listiny z\u00e1kladn\u00edch pr\u00e1v EU.<\/p>\n<p>\u010clenka Evropsk\u00e9ho parlamentu za ESN Christine Andersonov\u00e1 (AfD) uvedla:<\/p>\n<p>\u201cARD, ZDF a Deutschlandradio nepodl\u00e9haj\u00ed dohledu obecn\u00fdch st\u00e1tn\u00edch org\u00e1n\u016f pro ochranu osobn\u00edch \u00fadaj\u016f, ale m\u00edsto toho z\u0159\u00eddily sv\u016fj vlastn\u00ed, samostatn\u00fd, odv\u011btvov\u011b specifick\u00fd paraleln\u00ed syst\u00e9m. Podle evropsk\u00e9ho pr\u00e1va m\u016f\u017ee b\u00fdt takov\u00fd model platn\u00fd pouze tehdy, pokud spl\u0148uje stejn\u00e9 po\u017eadavky na objektivitu, nestrannost, nez\u00e1vislost na vn\u011bj\u0161\u00edch vlivech a struktur\u00e1ln\u00ed nez\u00e1vislost jako konven\u010dn\u00ed org\u00e1n pro ochranu osobn\u00edch \u00fadaj\u016f.<\/p>\n<p>M\u00e1m v\u00e1\u017en\u00e9 pochybnosti, zda tomu tak skute\u010dn\u011b je. Dohled vykon\u00e1vaj\u00ed org\u00e1ny jmenovan\u00e9 samotn\u00fdmi radami pro rozhlasov\u00e9 a televizn\u00ed vys\u00edl\u00e1n\u00ed, zat\u00edmco financov\u00e1n\u00ed je zaji\u0161\u0165ov\u00e1no z rozpo\u010dtu p\u0159\u00edslu\u0161n\u00e9ho vys\u00edlac\u00edho subjektu, ani\u017e by byl pov\u011b\u0159enec pro ochranu osobn\u00edch \u00fadaj\u016f v oblasti vys\u00edl\u00e1n\u00ed vybaven pravomocemi k ukl\u00e1d\u00e1n\u00ed pokut. To vyvol\u00e1v\u00e1 ot\u00e1zky ohledn\u011b skute\u010dn\u00e9 struktur\u00e1ln\u00ed nez\u00e1vislosti a \u00fa\u010dinnosti vym\u00e1h\u00e1n\u00ed p\u0159edpis\u016f. V\u0161em pl\u00e1tc\u016fm koncesion\u00e1\u0159sk\u00fdch poplatk\u016f doporu\u010duji, aby od ARD a ZDF po\u017eadovali jasn\u00e9 informace ohledn\u011b ochrany sv\u00fdch osobn\u00edch \u00fadaj\u016f. Podle GDPR maj\u00ed pl\u00e1tci koncesion\u00e1\u0159sk\u00fdch poplatk\u016f jasn\u00e1 a vymahateln\u00e1 pr\u00e1va na p\u0159\u00edstup k \u00fadaj\u016fm, jejich opravu, pod\u00e1n\u00ed st\u00ed\u017enosti u p\u0159\u00edslu\u0161n\u00e9ho dozorov\u00e9ho \u00fa\u0159adu a soudn\u00ed n\u00e1pravu.<\/p>\n<p>Pokud nebudou spln\u011bny evropsk\u00e9 po\u017eadavky na struktur\u00e1ln\u011b nez\u00e1visl\u00fd a \u00fa\u010dinn\u00fd dohled nad ochranou osobn\u00edch \u00fadaj\u016f, mohlo by to m\u00edt d\u016fsledky podle pr\u00e1va Unie.
